General provisions affecting trade unions
The following provisions shall apply to trade unions:

A. The freedom of association and the freedom to establish, merge and split are guaranteed to all persons.

B. No discrimination shall be made on any ground whatsoever against any person because of his membership in a trade union or trade union organization.

C. Every member of a trade union shall have the right to participate in its activities.

D. Every member of a trade union shall have the right to attend its meetings without interference by the employer or public authorities, provided that such meetings do not disturb production or cause disturbance within the factory or other places where work is carried out; provided further that such meetings do not disturb the employees engaged in other activities; provided further that such meetings do not disrupt traffic nor interfere with navigation along waterways, railways or roads; provided also that such meetings take place at times when work does not require attendance at work and that no interruption of work takes place as a result thereof; provided further that no disciplinary action shall be taken against any member for attending such meeting so long as it does not involve discussion which may lead either directly or indirectly to industrial action for which he has been duly authorized by his superiors; but where an employer suspends an employee pending investigation into his attendance at such meeting is not allowed.
