Contract of service and contract for services

The two types of contracts are fairly similar, but there are some important differences. Contract of service is a formal agreement between two parties to provide a service or product over a specific period of time. For example, you agree with your plumber that he will install new plumbing fixtures in your house. In this case, you have created a contract of service by signing an agreement with the plumber.

Contract for services is more like a contract for goods. If you hire an architect to design your house and build it, the architect has entered into a contract for services rather than a contract for goods (although he or she might agree with you on both).

The main difference between these two types of contracts is that under a contract for the provision of services, performance must be delivered within a specified time period, whereas under a contract for the provision of goods, performance must be delivered within a specified time period. The parties to such contracts agree on the definition of terms which are applicable to them (for example, what constitutes an acceptable performance).

Contracts for the provision of services usually involve one party who will provide something (the provider) and another party who needs it (the customer). The provider may provide his own work or he may subcontract it out. A contractor is someone who undertakes work on behalf of another person or company without being paid directly by that person or company.
